Democracy Unlimited Moves

Matt, Matt, Matt; What did you have to go and do that for?

Matt Owen, husband of Virginia Bass, apparently complained to the City of Eureka when he found out Democracy Unlimited didn't have a permit to be operating at Fourteenth and M Streets in Eureka where they have their headquarters. The City won't issue a permit to them now, so they'll have to move by the end of the year.

Who cares if they don't have a permit? Hey, I don't mind a little good old fashioned fun, but over this?

I'm sure Democracy Unlimited is no more disruptive to that neighborhood than a lot of other houses are in other neighborhoods around town. Heck, even the Matteolis have their fair share of large family parties that tie up parking for half a block around. With all the coming and going out of their house, if I didn't know better, I'd think it was some crack house.

If you really felt strongly there was a problem about this, you should of at least waited until after the election so this wouldn't seem like so much of a childish political prank.

As far as the Kaitlin and Dave are concerned, it will likely just be a small hassle for them. I assume they'll still be able to live there. Heck, they could probably still have meetings there. They'll just need to find a new place to call their official headquarters. Any volunteers out there? Mresquan? SAF? Heraldo? Eric?

Good point. Seems to me all they need is a different official address. As far as pancake feeds, I guess we need to have a permit for someone to have a pancake feed? Probably so, even though it's no different than someone who has big family parties all the time.

If Dave and Kaitlin stay there, does that mean they have to evict their tenants and not allow any guests to come over? I should hope not.

Bottom line is, there are going to be issues to be resolved with neighbors. I don't think we need to go around pointing the fingers at each other over what activities neighbors have at their houses all the time. Remember that whatever goes around, comes around.

I realize I'm being overly simplistic, but we need to learn to live and let live. I wouldn't want someone hassling me to have to get a permit for activities at my house so I'm not going to hassle them to get a permit for what they do at their house.

It's hard for me to understand the hypocracy. Kaitlan wants to use rules, change rules, to push her agenda but she and her supporters snivel, whine, and complain when they are expected to follow the rules? Just the kind of person Eureka needs!

Maybe when Home Depot comes in Kaitlan can get a job in the garden department?

Hi Fred,

Maybe Mr. Owen should check and see if Jeff Leonard had some sort of permit to exclude him from following the Brown Act when he knocked Police Review out of commission in Eureka a few months ago.

Leonard's motion to establish a "public safety committee" exclusive of police review powers, was done without notice and without a chance for public comment.

Of course, Leonard knew what he was doing was a probable violation but said he didn't care and "I'm going to do it anyway".

Maybe I am wrong though, it was all caught on tape.

Anyway, permits are important, I hope the good folks at DUHC work it out with the city.

I seem to remember a really nice church group had to work out some permit problems and everyone on the council was really pro-active in resolving the situation, had something to do with neighborhood impact concerns, parking and crime and such.

Could have been at that very same meeting Leonard knocked police review out of commission.

Not for sure though, it is on tape, somewhere, for sure.

You're probably referring to the Nazarene Church in Eureka, almost next door to me. Yes, they had a problem cause they set up a playground for their school, what's it called...Redwood Christian School?

I actually felt the same way about that, although I'll admit, that probably was a bit more disruptive than DU headquarters with all the people dropping and picking up their kids five days a week.

But, like I told the church girl that came around asking for comments, "It always sucks living around a church or a school, but the Matteolis across the street hold a fair amount of parties and have kiddie play stuff in their yard. What am I gonna do, get on their case for having lives?

What kind of got me the most about that was the guy that started the big stink about the church school playground, James Emery, doesn't even live here most of the time. I've been told he spends most of his time in San Francisco.

I felt the issue was kind of silly, although, in fairness, I spoke with one other guy who lives closer to the church than I do and he was a bit unhappy with the situation.

Aside from that all, as the Times- Standard pointed out, this is on E street, one of Eureka's main drags. Hardly the area to move in to and complain about the noise.

Me again Fred,

Leonard directed staff to agendize his Public Safety Commission exclusive of Police Review during council reports on May 2, 2006.

Also, I believe at Bass-Jackson's request, he also directed staff to agendize public discussion of a town hall meeting, with support from the State Attorney's office, concerning the Moore shooting.

I never heard anything about the town hall meeting after that night.

That was the same night council (1-4 with Kerrigan supporting) voted down the same-sex marriage resolution.

The discussion about the church group permit variance must have happened on April 18th, but the minutes are not posted for some unknown reason re that meeting on the city web site.

I remember that because Scott Thomason spoke in support of the church group variance, he is VP of Business Affairs over at CR and the principal brain behind Measure Q.

He authored a successful measure similar to Measure Q for the community college district he worked for before his job at CR.

We might be talking about similar variances but different church groups, the issue I raised was concerning a smaller group that only had a few people going in an out most of the time but every once in a while had a couple of dozen or more coming and going.

Alot like DUHC it seems to me.

Anyway, I better finish up here, I am researching a $283,500 grant the Humboldt County Probation Department recieved from the Board of Supervisors a few years back.

The county got money ($2,000,000 or so) from the state as a bonus for kicking families off of welfare.

The probation department got the grant to help at risk kids, you know, foster youth and other children having a tough time, like I was when I was a kid.

The church deal on E Street was any and everything but a zoning matter. The woman who lived within spitting distance from the swings was nearly driven to suicide. I wondered why she didn't get more support from her husband-who is a judge and works out of town. Perhaps this is the person who 'spends most of his time in San Francisco'.

I was present for some of those council meetings and the 'church people' certainly did not display the Christian qualities you would expect. They were mean.

You may wish to have a checkup for your brain fade-the blog you are posting on has the topic concerning Democracy Unlimited having an office in a residential neighborhood-much goings on traffic, pancake feeds etc and our city manager has stated this property is zoned (R) Residential which would not allow for this particular use. Not even 'with' the business license DU did NOT apply for/receive. Kay?

Did Matt Owen bring up his problems to Kaitlan and David? If he did, and they ignored it then they should have been reported. If not then he is just being mean spirtited.

From the quote in the paper it sounded like the neighbors don't mind. C'mon people - do we really care if some nonprofit works out of a residential house? I bet most people working from home aren't permitted. And I bet the city doesn't care.

Only if there is a problem should it be looked into - and from the T-S story it doesn't sound like there was.

4:25 why can't you just read the whole blog? No, David and Katlin did not have a permit for a 'home business' BUT it wouldn't matter because that type of business with huge impacts to traffic (Greg will understand this) ARE NOT permitted in neighborhoods.

Virginia didn't do anything at all-it can't backfire too much I'd say because 'Democracy Unlimited' is pretty limited- its rather unknown!

All the issues you mentioned are much more serious that having meetings and pancake breakfasts.

Clearly many people posting here have no idea what the rules are for a home business. I have a 'home office' in the County, which may have slightly different rules, but as a 'cottage business' it can be run out of my house in a residential neighborhood. I have to have a business license, of course, but there is no zoning issue involved.

The issue, as I understand it, is what transpires as 'business.' If they are simply running their business together, sending and receiving mail and packages, then I believe they are free to do so. If their business involves clients or customers on site, then I believe they have to have liability insurance in case someone trips or whatever. It is only if the business creates traffic or requires more parking than is provided for as a residence that there must be additional permitting.

Seems to me their only problem is in calling their pancake breakfasts a 'business gathering' rather than a 'social gathering.' Does anyone really believe that no business transpires at the Matteolli house, the Arkley house, the Bass house, the Leonard House, the LaVallee house, the Kerrigan house, etc? A great deal of business gets done in social settings. If their pancake breakfasts were for "David and Kaitlin" rather than "DUHC", there would be no issue here.

I heard that the mayor tipped off Salzman on the letter which was sent to the city manager. The letter supposedly says to wait until after the election to take action. When the mayor got a hold of the letter he immediately called Salzman who in turn threatened to sue the city if Dave Tyson didn't take action immediately, as Salzman in his cheap demeanor knew that putting this out in public now would seem like a hit piece by Virginia's campaign. This reminds me so much of what he did with the coalition for jobs.

Since someone brought up the playground at Redwood Christian School earlier, I'd like to clarify a couple of things, foremost that the School knowingly didnt get a permit/variance (I forget which it was, its been a couple of years). Anyway, the School in fact did contact City staff and was told they didnt need to do anything, that they could in fact have a playground. It only came up at a planning commission meeting when the Nash's and Mr. Emery were protesting another request by the church and school to add something that was completely unrelated to the playground. Mr. Emery in his investigation into the planning/building endeavours of both the school and church discovered that in fact, a modification of some sort was needed by the school to operate the playground.

At that point, the school initated that process, and the playground was eventually approved by the City Council.

As far as the neigbors, that 3:03 is mentioning, the Nash's you might be interested to know that their kids had both attended the School and that they bought the house next door for the convenience of living next to the school their kids attended. In fact both Mr. and Mrs. Nash volunteered in the construction of the playground, and their are donor tiles with their kids' names & handprints inside the playground wall.

I do know they eventually withdrew their kids from the school, but that was after the playground was built.

As far as Mr. Emery goes, he was spotted several times videotaping through the windows of the church and school. Thisnt a blind accusation - I called Eureka PD on him. He spent thousands of dollars on sound studies and the like...and the school did the same, and through the proper public process, the school gained their playground, and both the Times-Standard and Eureka Reporter editorialized in favor of the school.

As far as 3:03's assertions that some of us "church people" being mean, I have to say I attended those meetings as well, and I certainly dont think vigoursly defending yourself and your kids from wild accusations, and yes there were some very wild accusations out there, necessarily makes us "mean"...We are certainly going to stand up for ourselves.
As far as Mrs.Nash being nearly driven to suicide...that poor woman has had mental issues that she talked about ad nauseum at each and every meeeting she spoke at during this process. She went on at length about the meds she was on. I doubt that the school caused those issues.

6:41 I would love to play the audio of those council meetings because our memories differ greatly. You 'church people' tortured that poor woman and smiled about it-I was sitting a row behind. It was horrifying to watch!

Another good point is that this is a heated election and Matt Owen’s complaint got immediate action. Other complaints, even about things done by some of the incumbents, have often been ignored for weeks and months. And with Virginia’s husband making the call, it appears that those in charge look are both hypocritical and petty.

6:24 Everything I know about Virginia tells me she wouldn't even know how to pick a bad hubby-she and her ex (Jackson) are still good friends he even helps with the campaign to this day-they are GOOD people unlike some other good people who are the co-targets of this blog.

Virginia Bass is one of the hardest working people in this county-she has endless energy and endless class. And if someone, somewhere says the letter Matt sent asked to save the issue until after the election-I do believe Peter is the 'leaker' as you reported. I, too, remember the Redwood Christian School issue well. Having friends who are members we got to hear both sides.

The pastor behaved shamefully and set a terrible example for the children and adults both. Breaking the law while claiming that it's easier to be forgiven than it is to get permission showed him to be a Christian in need of remedial study and training.

No more donations to them for us.

1146, what in the world are you talk about? The fact of the matter is that the school contacted city staff before the playground went in, and the staff said no permit or variance was needed. Later, when Mr. Emery discovered it was in fact needed, the school closed the playground and went through the required public process and got the playground approved. How is that breaking the law?

Group homes are not licensed by the city or county and federal funding would be lost if govt tried to regulate these in any way. Same for Safe and Sobers.

No business license is required to share you house when evryone chips in for rent/utilities that I know of.

It was the headquarters of a business with a traffic impact-it only takes a neighbor or two to complain when that rule is broken, and admitedly-it was broken. They can still live there, share their home with others. Its still a free country...

I don't know that it makes much difference, as far as between Eureka and Arcata pricing for houses. There was a story in one of the papers today, I believe it was the Times- Standard, about some kid that moved up here to go to Humboldt State. He supposedly can't find a place to live.

No one has claimed that Democracy Unlimited doesn't have a business license or a permit. So far as I know, they do. The only 'rule' that is at issue here is Municipal Code Section 155-215(A)10, which reads: "A home occupation shall not create pedestrian, automobile, or truck traffic significantly in excess of the normal amount in the district."

Seems highly interprative, don't it? What are the normal traffic counts in that district? What is the specific amount of traffic at their house? How much of that traffic is business, and how much is personal? Where is the line between a 'social visit' and a 'business visit'?

Has Virginia Bass had any campaign meetings at her house? Wouldn't that be a 'Home Occupation' business? Does she have a permit for that business at her residence? How much traffic has been generated? Sounds like Owen is just being petty, and a fool.

After 145 posts someone actually bothers to cite the relevant municipal code, and that is how you respond? Did you even think before writing that?

The assertion that they do not have a conditional-use permit assumes that they actually need one. Unless their home business creates "traffic significantly in excess of" normal, then they do not. Again, "significantly in excess" is highly interperative.

It seems to me that those who are loudly thumping their chests about the law know little about it, and care even less.

I don't know if non- profits need a permit if they get insignificant traffic. I suspect they do. I think businesses do, even if you're just doing business selling things on the home computer (it would be difficult for the city to catch you doing that, though).

But this is highly interperative as you say. I'm sure some households generate more traffic with family and friends than some businesses, or in this case, a non- profit, do.

I'll admit to not living in the neighborhood of DU, but I drive by there probably once a week. I don't believe I've ever seen more than two cars parked out in front of that house.

Oh, I might mention I've heard there's an ordinance, or some such, in Eureka that says you can't have something like more than two or four yard sales a year. I'm not sure I really have a problem with that, especially as it doesn't seem to be enforced all that often.

I did notice some people move into a house on Henderson Street some time ago. Seemed like right off the bat the gal would be laying stuff out in her yard nearly every morning to sell. I'm guessing the city finally got on her case as she stopped doing it all of the sudden, or so it seemed to me.

I'm not sure anybody wants a yard sale going on next door five days a week. Understandable problem there. Interesting thing was, I don't recall ever seeing anyone stopping to check out her wares, so I don't know that she really caused any traffic problems.

Then, a couple months ago, my next door neighbor had stuff laying out in her yard for three or four days in a row trying to sell stuff. People were stopping for her. I was hoping this wasn't going to be a regular thing, although I wasn't planning on squealing on her if it was.

Luckily, once she got most of her stuff sold, she stopped the yard sales.

I don't know that I care about a lot of these ordinances if they're rarely enforced. I don't like the idea of neighbors using ordinances just to hassle each other.

Oh, and as yet another aside: I've heard that there's some guy in Eureka that does a lot of yard sales. I was under the impression that's how he made his living.

To get around the yard sale ordinances, I guess he'd pay people to let him run his yard sale at their house. I only know that cause I met a guy that used to live on Henderson Street and he had a yard sale one day, with a bunch of stuff I couldn't believe was his. He told me some guy paid him for use of his yard.

I never asked if it was a fixed fee or a percentage of the sales that the property owner received.

Frequent yard sales do signify having a busines and that would require a business license and a permit Fred-an 'antiques' store or 'rummage' does matter. TGhey need to locate in a business district.

Henderson Center is a really tight area-a psycologist spent over a year trying to get his business license and he was required to have handicap parking.

The thing is not that there isn't very much traffic and this is subjective-the thing is...they didn't go through the process and ask about a business license/permit, go to hearings etc like everyone else.

If the neighbors DID NOT have a problem, they would have been able to submit their approval most likely-but No One Asked.

There is some tie between the T-S , Neely and government grants . Neely is tied to the RCAA and i found , David Lippman of the T-S name pop up went i did some investigating into our City recieving governmental grants and if that's not enough , Jill Geist , a member of the rcaa endorses , Bass .Hmmmmmmm , seems like they are all tied together whom our infamous Mayor is also part of the RCAA. Funny thing 'cause the T-S is endorsing all those who work for the RCAA to bring more shelters into , Eureka . Easy brainer . Just go figure . It's BIG money for them to foul up our City some more .

i drive my that house on 14th street all the time. it is huge! it would be wasteful to have only 1 person living there.

Indeed. Nowadays, with the price of rentals, people have no choice but to have people sharing the rent, which causes it's own share of problems.

I know one place on I street was for rent for something like $1500. Few people could afford a place like that. Ended up a bunch of college students rented it. Instead of the one or two cars that used to be parked there under the prior owner, there ended up being like five or six. Made it a real pain for me to park around there sometimes.

Although I can't vote for her because I am outside the city limits, Bass seems the most honest, reasonable and respectable of the choices.

The point is that Virginia, when asked about a possible mistake in her FPPC filings-looked into the matter. Rather than split hairs and whine about it like the Democracy Unlimited apologists-she took action and corrected the paperwork EVEN THOUGH she had done nothing wrong to begin with.

Kaitlin having roommates and pancake breakfasts to make ends meet was not the issue-THE ISSUE: was that a business that SHOULD HAVE ASKED about permits in a residential neighborhood and DID NOT ASK about permits-and WOULD NOT have received a permit for meetings/pancake breakfasts from the City of Eureka because of the traffic impacts—did it anyway and is now MAKING EXCUSES instead of fixing the problem.

Go ahead and blame people for blowing the whistle if you like-it just makes you look badder than usual to try and make an issue... when Virginia already fixed her paperwork and it wasn’t a true violation in the first place. It looks totally desperate, makes Peter look like he thinks he’s losing THAT BADLY which now-he is. He could have at least made a face saving showing before all the crap you tried to pull. BUT NO-OOOO! Let’s gamble big time and go down in flames! You guys crapped out finally-it’s a JOY to watch you fall!
