Measure T Going To Court

Finally. The Pacific Legal Foundation is taking Measure T to federal court. Hard for me to believe they can lose this one. I wonder who got PLF's attention focused on this one?

Measure T was such an egregious violation of our First Amendment rights it was bound to be challenged. You're right Fred - there's no way they can lose this one. Congratulations to the local businesses that are leading the way!

Wow two local companies that have both been here longer than i have 40 plus years and probably 500 employees between them challenging a measure brought to us by the green party and thier leaders who have been here less than 10 years and employ no one

Where did you hear it was two local companies? That PLF press release didn't mention it, or did I miss something? Could you be more specific as to which companies are involved?

The other is O & M Industries, of Arcata.

This piece of sh-t is finally going to be killed and thank god for that. What I really found disgusting about it was that it was supported by the local democratic committee who didn't give a damn about the free speech and political process problems that the measure had. I mean, it didn't bother them at all.

I share your enthusiasm about overturning this ill conceived special interest power grab.

I also lament that what it purported to address, the need for campaign finance reform, is still no closer to local implementation.

I am still ready to work with any groups to put together an ordinance to impose a reasonable cap on single campaign donations from ANY source. We would need to work out how much ($500, $1,000?), under what circumstances if any could donations be doubled (husband/wife, worker/employer), and how to handle in-kind and auction donations/purchases.

As long as there is an even playing field, I think a huge percentage of the community would back it.

I can't get the actual complaint to load. Maybe it's a Safari thing.

I wonder if the McKinleyville School District Bond Measure people will also join in the suit - that is IF the DA goes after them for the Measure T violations.

Gallegos, the poster boy for Measure T, the horse he got to ride back into office - will he file against a school, and parents?

Face it, Measure T was created for one reason and one reason only and that was to stop Palco from ever having a chance to defend themselves against a rogue DA. A DA who had filed a lawsuit against them at the behest of their enemies, his backers.

It doesn't limit Unions and it doesn't limit Orgs and PACs - it creates an uneven playing field, stacked in the activist's favor.

They'll fight it - it is a valuable weapon for them - IF they can use it here they create precedent, and can use it elsewhere.

But this time, they will lose.

It is not the Green Parties fault that a deflocked attorney managed to manipulate the locals(including Democrats) in thinking that this would change corporate control. This was all about David Cobb and his agenda, control, ego and the idiots who followed his lead.
Now the county has to spend monies on legal fees taking away funds from other departments which are hurting very badly. Good going David!

Measure T's campaign manager Kaitlin Sopoci-Belknap has an opponent I hear in her race for reelection to the water district board this Nov. Who is the opponent? Anyone have any idea about this?

The idea behind T is good, but the implementation is severely flawed. You have many local businesses that are excluded from the law's strict and biased language. This law is an obvious attempt to better the position of progressives in the county, who enjoy contributions from organized labor, while the conservative groups rely mainly on business.

A better scenario is a monetary cap on contributions. That is far more equal than outright banning a group's voice.

What;s hilarious is the little string of phony "experts" Belknap brought in to tout the phony Measure T - who swore they would help defend it. Let's see 'em do it.

Think they'll apply for a license to practice in this state?

I say make Gallegos defend it. It's his baby. He is responsible. He claimed he had reviewed it and found it to be constitutional - har har - we now know what his legal opinion is worth with two spectacular failures under his belt.

This time, his appearances should be videotaped.
