Prop 8 To Be Challenged...

..as it should be, according to the Sacramento Bee. YESSS! I was hoping opponents weren't just going to let it go.

We'll need to keep eyes and ears open for ways to support this effort.

Let's see if we understand this correctly. Firstly, the filing states: "...the initiative process was improperly used in an attempt to undo the state constitution's core commitment to equality for everyone." OK, does "everyone" include those immigrants from the middle east who wish to marry their goat? Or those whose religion allows them to engage in polygamy or polyandry?

Secondly, does anyone else find it odd that the same court that was overruled by a vote of the people will be ruling on the validity of that vote?

Just askin'.

I think Fred that people are getting woefully tired of the government deciding what we can and can't do in our homes.

This has no business on our ballot and no business in our constitution.

If we can't as a people embrace tolerance, how do you think an initiative or legislation can change anything?

I'd think that those opposed to Measure T passing here would disagree with you there.And this may come as a bit of a surprise to some who read this blog and others,but I don't really support going to the courts to remedy social inadequecies in our system.I do certainly view those who supported prop 8 as complete bigots,but to their "credit",they brought the issue in front of voters,and bigots outvoted us opposed.
But well,it is certainly true.....and good to an extent,that the courts exist to protect those in the minority.I sure wish this prop failed so we didn't ever get to this point.

There may be another legal challenge once the vote is certified. 18000 couples having married will probably remain married as there's nothing in the provision which makes the measure retroactive. If so, other gay couples who want to marry can sue on the basis of the equal protection clause in that there is no compelling state interest for the discrimination between those couples who married prior to the election and those who want to marry after.

mresquan makes a good point - the same people who are saying that the 'will of the people' with regards to Measure T should be defended in court are now saying that the 'will of the people' which was overturned by a couple of judges, and then reaffirmed by another 'will of the people' despite a convoluted and confusing initiative should be fought in court.

Let's have some consistency...

Honestly - doesn't anyone remember the 60s/70s - people were living together, living in SIN, because they DIDN'T WANT OR NEED THAT LITTLE PIECE OF PAPER. It was a point of pride.

What happened?

The way it looks to me right now - the yes on 8 ads were correct in one thing - "Whether you Like it or not!" this is going to be shoved down the public's throat. The attacks on the Mormons has already begun in earnest with the comment that "we are going to destroy Utah's brand."

Yeah, the activist hatred needs somewhere to focus now that Barack has been elected, and all the world's ills are still here.

Yes, Rose, just the way interracial dating and marriage were "shoved down the public's throat." Do you regret that too? Are you sorry you didn't have a chance to vote that down?
